Ski Area Operations, Rentals & Lessons
Guest Acknowledgment, Assumption of Risk & Disclaimer
This notice applies to all guests participating in skiing, snowboarding, equipment rental, lessons, or related winter activities at Villa Roma Resort & Conference Center.
1. Assumption of Risk
Skiing, snowboarding, and related winter activities are inherently hazardous recreational activities. Risks include, but are not limited to: variable weather and snow conditions, ice, uneven or changing terrain, natural and man-made obstacles, lift operations, collisions with other participants, and equipment malfunction or failure.
By entering the ski area or participating in any winter activity, guests voluntarily assume all inherent and non-inherent risks, whether known or unknown, to the fullest extent permitted by law.
2. Ski Area Operations
Fay Hospitality Catskills LLC d.b.a. Villa Roma Resort & Conference Center reserves the right to open, close, limit, or modify ski trails, lifts, lesson programs, and related facilities at any time due to weather, safety conditions, maintenance, staffing, or operational requirements.
Trail difficulty ratings, signage, and markings are guides only and do not eliminate risk. Guests are responsible for selecting terrain appropriate to their ability.
3. Equipment Rental – Guest Responsibility
All rental equipment is provided “as is.” By renting equipment, guests confirm that all personal information provided (including height, weight, age, ability level, and boot size) is accurate.
Guests acknowledge that:
- Ski bindings and equipment reduce but do not eliminate the risk of injury.
- No equipment setting or adjustment guarantees injury prevention.
- Equipment must be inspected before use and used only as intended.
The renter accepts full responsibility for the care, control, and return of all rented equipment. Lost, stolen, or damaged equipment may be charged at repair or replacement value.
4. Lessons & Instruction
Ski and snowboard lessons are provided for instructional and recreational purposes only. Instruction does not remove or reduce the inherent risks of skiing or snowboarding.
Guests acknowledge that:
- Instructors provide guidance based on observed ability but do not control weather, terrain, equipment performance, or the actions of other guests.
- Advancement to terrain beyond one’s ability is undertaken at the guest’s own risk.
- Skill improvement and safety outcomes are not guaranteed.
Minors must comply with all supervision and participation requirements set by Fay Hospitality Catskills LLC d.b.a. Villa Roma Resort & Conference Center.
5. Health, Fitness & Conduct
Guests confirm that they are physically capable and medically fit to participate and are not impaired by alcohol, drugs, or medication that could affect judgment or coordination.
All guests must follow:
- Posted signage and trail markings
- Instructions from ski patrol, instructors, and resort staff
- Resort rules, policies, and safety guidelines
Failure to comply may result in removal from the ski area without refund.
6. Release of Liability
To the fullest extent permitted by law, guests agree to release, waive, and hold harmless Fay Hospitality Catskills LLC d.b.a. Villa Roma Resort & Conference Center, its owners, affiliates, officers, employees, contractors, instructors, and agents from any claims or liabilities arising from participation in skiing, snowboarding, equipment rental, lessons, or related activities, except where prohibited by law.
7. Acceptance
Participation in ski area activities constitutes acknowledgment and acceptance of this notice. For minors, acceptance is provided by a parent or legal guardian.
